Title - Senior Legal Manager, Colombia, Peru and Local Representative Markets in Latin America

Commercialization and Development Law Department


This position will be primarily responsible for providing regulatory and commercial legal advice to the business operation in Colombia, Peru and the markets where BMS products are commercialized through third parties in Latin America (known as Local Representative markets).

The role will provide legal advice and support on complex regulatory and commercial issues, assessing and managing legal risk, ensuring compliance with all applicable laws and regulations, providing training and education on relevant legal matters, and responding to the legal needs of the organization.


Position will report to the Legal Director, Latin America, with a dotted line to the Senior Legal Director, Local Representative Markets. This position will not have direct reports
.

Main Responsibilities:


Advise Business Operations & Ensure Proper Governance and Compliance

  • Review of daytoday business operations in Colombia, Peru and Latin America Local Representative markets, including commercial, R&D, medical, market access, business analysis and enabling functions such as finance, HR, sales force effectiveness, logistics, and the like.
  • Proactive participation in all relevant initiatives of the local markets, including its evaluation and implementation accordingly.
  • Support and assist in all business development activities and new projects that may arise from time to time.
  • Provide timely legal advice in all areas of law and regulation to ensure compliance with all applicable laws and regulations, including local industry code, if applicable, manage legal risk and prevent legal issues arising, as well as reactive support as and when legal issues arise.
  • Keep the local management informed of potential liability of ongoing litigation as well as potential contingency and new litigation.
  • Develop in close collaboration with other legal practice groups and offer a range of legal guidelines and trainings to assist in the speedy resolution of legal matters and ensure that commercial have access to clear concise and tailored legal advice to appropriately achieve their business goals.
  • Participate as a member of the local leadership team meetings, as applicable.
  • Collaboration with the Innovation Law to support the defense and protection of IP rights.
  • Participation in the different legalrelated working groups/committees of the local industry associations.
  • Proactively obtain and refine information on external trends and challenges, to share relevant insights within the Law Department and to provide strategic legal advice to the business.
  • Assure compliance from the Corporate Governance perspective of the local BMS entities in the local markets in full coordination with the Corporate Secretary team.

Support the Law Department

  • Support members of the Law Department. Work closely with colleagues from Compliance, Corporate Giving, and other practice groups, in particular IP, Transactions, Employment, Litigation, Privacy, Corporate Secretary, R&D, among others.
  • Communicate directly and openly, contribute to seamless collaboration across the Law Department with positive, solutionoriented approach.
  • Escalate issues appropriately. Share best practices and learnings from mistakes to allow further improvements. Leverage the experience amongst the team, where appropriate.

Manage external counsel

  • Properly leverage external legal support where no internal resources exist.
  • Ensure that all legal services are provided in the most costefficient manner, and that all legal spend is managed within the budget.
  • Seek ways to improve the efficiency of the department. Manage the level of spend with external counsel by regularly monitoring and reporting external legal expenses, negotiating favorable fees and doing as much work inhouse as possible.

Qualifications:


  • Law degree and qualification to practice law in Colombia.
  • Minimum of 7 years of professional qualified experience, preferably in lifescience/pharmaceutical law.
  • Working experience with multinational companies or global law firms.
  • Experience with providing legal support to countries in Latin America other than Colombia, such as Peru, Central and South America will be a plus.
  • Availability to travel locally and internationally.
